Who is this green stock photo girl?

Just by happenstance, I stumbled across two completely unrelated (save their desire to go green) websites that both included the same stock image of a girl on a green grassy hill with a laptop.

Does it matter who was first? --or should both designers get a FAIL for using the same image, not properly licensing it, etc, etc. Or maybe someone's in the right and Getty Images dropped the ball...

Either way, it's always interesting to me to find this kind thing on the internet.  It reminds me of when they discovered the similarities between Barack Obama's website and the campaign site of Israel's Benjamin Netenyahu...
